These Research Use Terms & Conditions, together with our Privacy Policy, Refund Policy, Shipping Policy, and any other policies posted on this website, govern your access to and purchase of products from BioLight Labs.

By accessing this website, creating an account, placing an order, checking the agreement box at checkout, or purchasing any product from BioLight Labs, you acknowledge, represent, warrant, and agree to the following terms.

1. Research Use Only

All products offered by BioLight Labs are sold strictly for laboratory research use only.

BioLight Labs products are not drugs, medications, biologics, foods, dietary supplements, cosmetics, medical devices, or consumer health products. They are not intended to diagnose, treat, cure, mitigate, or prevent any disease or condition.

BioLight Labs products are not intended for human or animal use of any kind, including but not limited to:

• ingestion;
• injection;
• inhalation;
• topical application;
• implantation;
• personal experimentation;
• cosmetic use;
• therapeutic use;
• diagnostic use;
• veterinary use;
• compounding for patient use;
• resale for consumer use; or
• use in or on any person or animal.

Any purchase, possession, handling, transfer, or use inconsistent with these Terms is strictly prohibited.

2. No Medical, Health, or Treatment Claims

No statement on this website, product label, certificate of analysis, marketing material, email, social media post, customer service communication, or other BioLight Labs communication is intended to be, or should be interpreted as, medical advice, health advice, prescribing guidance, dosing guidance, treatment recommendation, diagnostic guidance, or a claim of safety or efficacy for human or animal use.

BioLight Labs does not provide medical advice. You should not use any information from BioLight Labs to self-diagnose, self-treat, treat another person, treat an animal, modify medication use, or make health-related decisions.

Any references to published studies, biochemical pathways, mechanisms of action, receptor activity, molecular targets, or scientific literature are provided only for general research-context discussion and do not imply that any BioLight Labs product is safe, effective, approved, or appropriate for human or animal use.

3. Purchaser Qualification and Certification

By purchasing from BioLight Labs, you certify that:

1. You are at least 21 years old.
2. You are purchasing solely for lawful laboratory research purposes.
3. You have the knowledge, training, facilities, equipment, and procedures necessary to safely receive, store, handle, and use research materials.
4. You understand the hazards associated with research compounds, peptides, solvents, reagents, and related materials.
5. You will comply with all applicable federal, state, local, and international laws, rules, and regulations.
6. You will not use any BioLight Labs product in or on humans or animals.
7. You will not resell, relabel, redistribute, compound, advertise, or otherwise transfer any BioLight Labs product for consumer, clinical, therapeutic, dietary, cosmetic, veterinary, or personal use.
8. You are not purchasing on behalf of a person or entity that intends to use the product for any prohibited purpose.
9. You have independently determined that the purchase, possession, and use of the product is lawful in your jurisdiction.
10. You accept full responsibility for any use, misuse, storage, handling, transfer, disposal, or consequences associated with the products after delivery.

BioLight Labs reserves the right to request additional purchaser verification, institutional information, research-use confirmation, or other documentation before accepting or fulfilling any order.

4. No Human or Animal Consumption

BioLight Labs products are not sterile unless expressly stated in writing by BioLight Labs. They are not manufactured, labeled, tested, packaged, or sold for administration to humans or animals.

You expressly agree that you will not consume, inject, apply, inhale, administer, compound, or otherwise introduce any BioLight Labs product into or onto any human or animal body.

You further agree not to provide, recommend, sell, distribute, gift, or transfer BioLight Labs products to any person or entity that may use them for human or animal consumption or application.

5. No Dosing, Reconstitution, or Administration Guidance

BioLight Labs does not provide and will not provide dosing instructions, reconstitution instructions for administration, injection instructions, cycle recommendations, therapeutic protocols, cosmetic protocols, or any guidance relating to human or animal use.

Any customer request for such information may result in order cancellation, account restriction, refusal of future sales, or other action at BioLight Labs’ discretion.

6. Regulatory Status

You understand and agree that BioLight Labs products have not been evaluated or approved by the U.S. Food and Drug Administration or any other regulatory authority for human or animal use.

You acknowledge that products sold by BioLight Labs may include compounds that are experimental, investigational, or not approved for any clinical, therapeutic, cosmetic, dietary, or veterinary purpose.

You are solely responsible for understanding and complying with the laws and regulations applicable to your purchase, receipt, possession, research use, storage, transportation, transfer, and disposal of any product.

7. Prohibited Uses

You may not purchase, use, or possess BioLight Labs products for any of the following purposes:

• human consumption;
• animal consumption;
• injection or infusion;
• topical application;
• medical treatment;
• disease prevention;
• diagnosis;
• cosmetic enhancement;
• performance enhancement;
• bodybuilding;
• weight loss;
• anti-aging use in humans;
• veterinary treatment;
• compounding for patient or consumer use;
• resale to consumers;
• repackaging or relabeling for commercial distribution;
• unlawful research;
• any purpose prohibited by applicable law; or
• any purpose inconsistent with these Terms.

Violation of this section constitutes a material breach of these Terms.

8. Customer Content, Reviews, and Communications

Customers may not submit product reviews, testimonials, comments, messages, emails, social media posts, or other communications suggesting that any BioLight Labs product was used in or on a human or animal, or that it produced any medical, therapeutic, cosmetic, performance, weight-loss, anti-aging, or health-related effect.

BioLight Labs reserves the right to remove, reject, moderate, or refuse to publish any customer content that implies prohibited use, unlawful use, or health-related claims.

Customer statements do not represent BioLight Labs’ views and may not be relied upon as evidence of product safety, efficacy, intended use, or suitability for any purpose.

9. Order Acceptance and Right to Refuse Service

All orders are subject to acceptance by BioLight Labs. Receipt of an order confirmation does not constitute final acceptance of an order.

BioLight Labs reserves the right to refuse, cancel, limit, or refund any order at any time, with or without notice, including but not limited to orders that BioLight Labs believes may involve:

• prohibited use;
• unlawful use;
• suspicious purchasing behavior;
• resale or redistribution;
• requests for medical, dosing, or administration guidance;
• false purchaser certification;
• regulatory risk;
• payment risk;
• shipping restrictions; or
• violation of these Terms.

BioLight Labs may refuse future sales to any customer who violates these Terms.

10. Product Information, Purity, and Testing

BioLight Labs may provide product descriptions, specifications, lot information, certificates of analysis, purity information, or other laboratory documentation when available.

Such information is provided for research identification and quality-control purposes only. It does not constitute a representation that any product is safe, effective, sterile, approved, or suitable for human or animal use.

You are responsible for independently verifying product identity, purity, concentration, suitability, storage conditions, and fitness for your specific lawful research application before use.

11. Storage, Handling, and Disposal

You are solely responsible for proper storage, handling, laboratory safety, environmental controls, documentation, access restriction, and disposal of all products purchased from BioLight Labs.

You agree to handle all products in accordance with applicable laboratory safety standards, institutional protocols, safety data sheets where available, and all applicable laws and regulations.

BioLight Labs is not responsible for degradation, contamination, misuse, improper storage, improper handling, unauthorized access, or improper disposal after delivery.

12. Shipping and Delivery

You are responsible for providing accurate shipping information and ensuring that the products may be lawfully shipped to, received in, and possessed within your jurisdiction.

Risk of loss passes to you upon delivery to the shipping carrier, unless otherwise required by law.

BioLight Labs is not responsible for delays, seizures, holds, inspections, customs issues, incorrect addresses, failed delivery attempts, temperature exposure during transit, or delivery problems outside BioLight Labs’ direct control.

If a shipment is returned, rejected, seized, abandoned, or destroyed due to legal restrictions, incorrect information, customer refusal, customs action, carrier action, or regulatory action, BioLight Labs may decline to issue a refund.

13. Refunds, Returns, and Cancellations

Because BioLight Labs products are research materials, all sales are final unless otherwise stated in writing by BioLight Labs.

BioLight Labs may, at its sole discretion, approve a replacement, store credit, or refund for damaged, incorrect, or missing items if the customer notifies BioLight Labs within 3 days of delivery and provides documentation requested by BioLight Labs.

Opened, used, reconstituted, altered, improperly stored, or tampered products are not eligible for return, replacement, or refund.

BioLight Labs may cancel and refund any order before fulfillment for any reason, including compliance concerns.

14. Chargebacks and Payment Disputes

By placing an order, you agree to contact BioLight Labs first to resolve any issue before initiating a chargeback, payment reversal, or dispute.

You acknowledge that digital checkout acceptance of these Terms, order records, shipping records, delivery confirmation, customer communications, and fraud-screening information may be used as evidence in response to any payment dispute.

BioLight Labs reserves the right to refuse future orders from customers who initiate improper or fraudulent chargebacks.

15. Assumption of Risk

You understand that research compounds may be hazardous and may have unknown characteristics, risks, impurities, degradation products, interactions, or effects.

You voluntarily assume all risks associated with purchasing, receiving, storing, handling, using, transferring, or disposing of BioLight Labs products.

You agree that BioLight Labs is not responsible for any injury, illness, death, property damage, economic loss, regulatory action, legal consequence, or other harm arising from misuse, prohibited use, improper handling, unlawful use, or violation of these Terms.

16. Disclaimer of Warranties

To the fullest extent permitted by law, BioLight Labs products and website materials are provided “as is” and “as available,” without warranties of any kind, whether express or implied.

BioLight Labs disclaims all warranties, including but not limited to:

• merchantability;
• fitness for a particular purpose;
• suitability for human or animal use;
• non-infringement;
• accuracy of informational content;
• uninterrupted website operation;
• absence of errors;
• absence of contamination or degradation after shipment;
• and compliance with the laws of your jurisdiction.

No oral or written communication from BioLight Labs shall create any warranty not expressly stated in these Terms.

17. Limitation of Liability

To the fullest extent permitted by law, BioLight Labs and its owners, officers, employees, contractors, suppliers, affiliates, agents, and representatives shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, regulatory, medical, legal, economic, or reputational damages arising from or related to your purchase, handling, use, misuse, storage, transfer, disposal, or inability to use any product.

In no event shall BioLight Labs’ total liability exceed the amount actually paid by you for the specific product giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

18. Indemnification

You agree to indemnify, defend, and hold harmless BioLight Labs and its owners, officers, employees, contractors, suppliers, affiliates, agents, and representatives from and against any claims, demands, damages, liabilities, losses, costs, penalties, fines, investigations, enforcement actions, chargebacks, expenses, and attorneys’ fees arising out of or related to:

• your breach of these Terms;
• your misuse or prohibited use of any product;
• human or animal use;
• unlawful purchase, possession, handling, transfer, resale, or disposal;
• false purchaser certification;
• violation of any law or regulation;
• negligent, reckless, or intentional conduct;
• third-party claims arising from your actions;
• or any statement, review, testimonial, or communication you make regarding BioLight Labs products.

19. Compliance With Laws

You are solely responsible for compliance with all applicable laws, regulations, import/export controls, customs requirements, institutional rules, laboratory safety requirements, and research regulations.

BioLight Labs makes no representation that any product is lawful for purchase, import, possession, research use, transfer, or resale in your jurisdiction.

You agree not to purchase or use any product where doing so would violate applicable law.

20. Binding Arbitration Agreement

You and BioLight Labs agree that any dispute, claim, controversy, or cause of action arising out of or relating to these Terms, the website, any purchase, any product, any communication with BioLight Labs, or any relationship between you and BioLight Labs shall be resolved exclusively through final and binding arbitration, rather than in court, except as expressly provided below.

This arbitration agreement applies to all claims, whether based in contract, tort, statute, fraud, misrepresentation, consumer protection law, warranty, negligence, product liability, equity, or any other legal theory.

The arbitration shall be administered by the American Arbitration Association, or another mutually agreed arbitration provider, under its applicable consumer or commercial arbitration rules. The arbitration shall take place in Ravalli County, Montana, unless BioLight Labs elects to permit remote, telephonic, or written-submission arbitration.

The arbitrator shall have the authority to resolve all disputes concerning the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or part of this arbitration agreement is void or voidable.

The arbitrator may award damages or relief only to the individual party seeking relief and only to the extent necessary to resolve that individual party’s claim. The arbitrator may not award relief for or against anyone who is not a party to the arbitration.

Judgment on the arbitration award may be entered in any court of competent jurisdiction.

21. Class Action Waiver

You and BioLight Labs agree that any dispute resolution proceeding, whether in arbitration or court, shall be conducted only on an individual basis and not as a class action, collective action, consolidated action, mass action, private attorney general action, or representative action.

You expressly waive any right to bring, join, participate in, or recover through any class, collective, consolidated, mass, private attorney general, or representative proceeding.

The arbitrator shall not have authority to conduct any class, collective, consolidated, mass, private attorney general, or representative arbitration.

If the class action waiver is found to be unenforceable as to a particular claim or request for relief, that claim or request shall be severed and may proceed only in a court of competent jurisdiction, while all remaining claims shall remain subject to arbitration.

22. Jury Trial Waiver

To the fullest extent permitted by law, you and BioLight Labs knowingly and voluntarily waive any right to a trial by jury in any dispute, claim, or proceeding arising out of or related to these Terms, the website, any purchase, any product, or any relationship between you and BioLight Labs.

23. Exceptions to Arbitration

Notwithstanding the arbitration agreement above, either party may bring an individual action in small claims court if the claim qualifies.

BioLight Labs may also seek injunctive, equitable, or emergency relief in a court of competent jurisdiction to prevent or stop:

• unauthorized resale;
• intellectual property infringement;
• misuse of BioLight Labs products;
• prohibited human or animal use;
• false or misleading public statements;
• fraudulent activity;
• regulatory risk;
• unlawful conduct;
• or violation of these Terms.

24. Governing Law and Venue

These Terms shall be governed by the laws of the State of Montana, without regard to conflict-of-law principles.

Subject to the Binding Arbitration Agreement above, any dispute arising from or relating to these Terms, this website, or any BioLight Labs product that is not required to be arbitrated shall be resolved exclusively in the state or federal courts located in Ravalli County, Montana.

You consent to personal jurisdiction and venue in those courts.

25. Intellectual Property

All content on BioLightLabs.com, including text, product names, graphics, logos, images, design elements, and website materials, is owned by or licensed to BioLight Labs and may not be copied, reproduced, modified, distributed, or used without prior written permission.

26. Website Information and Errors

BioLight Labs attempts to provide accurate information but does not warrant that product descriptions, specifications, pricing, availability, images, or other website content are complete, current, or error-free.

BioLight Labs reserves the right to correct errors, update information, modify product offerings, change prices, cancel orders, or discontinue products at any time without prior notice.

27. Account Termination

BioLight Labs may suspend or terminate your account, cancel orders, restrict access, or refuse future sales if BioLight Labs believes that you have violated these Terms, provided false information, requested prohibited guidance, engaged in suspicious conduct, or created legal, regulatory, safety, payment, or reputational risk.

28. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.

If any portion of the arbitration agreement or class action waiver is found to be invalid or unenforceable, the remaining portions shall continue to apply to the fullest extent permitted by law.

29. Updates to These Terms

BioLight Labs may update these Terms at any time. Updated Terms will be posted on this website with a revised “Last Updated” date.

Your continued use of the website or purchase of products after any update constitutes acceptance of the revised Terms.

30. Entire Agreement

These Terms, together with all policies posted on BioLightLabs.com, constitute the entire agreement between you and BioLight Labs regarding your use of the website and purchase of products.
